Conditions of Entry
CONDITIONS OF ENTRY
1. Instructions and information on how to enter and prizes form part of these Conditions of Entry. By entering, entrants accept these Conditions of Entry.
2. Entry is only available to:
a) AFL clubs appearing on the www.defencejobs.gov.au/armyaward website, within Australia whose members and players are Australian residents aged 12 years or over (as at Monday, 16th May 2011) (“Eligible Clubs”); and
b) general members of the public who are Australian residents and registered on www.defencejobs.gov.au/armyaward.
For the sake of clarity: (a) only individuals aged 18 years or over are eligible to win the Overall Individual (Player) Prizes and the Minor Individual (Player) Prizes; (b) only Eligible Clubs are eligible to win the Monthly Club Prizes and Overall Club Prize; and (c) individuals of any age are eligible to win the Weekly Individual Prizes.
3. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. The promotion commences Monday, 16th May 2011 and ends at 11:59pm AEST on Sunday 4th September 2011 (“Promotional Period”).
Overall Individual (Player) Prizes
5. To enter, an Eligible Club’s club coordinator (or a team member nominated by that club) (“Team Nominator”) is required during each week within the Promotional Period, to submit a vote for their best team player for that week (from each team representing the club). A Team Nominator may also submit a vote for the best player from each opposition team that week (from each team representing the opposition club, provided the opposition team is part of an Eligible Club), however this is not a mandatory requirement. Voting must be based on who best demonstrates qualities of courage, initiative and teamwork during the game (player must be an Australian resident aged 18 years or older as of Tuesday, 23rd August 2011). Nominations can be made by visiting www.sportingpulse.com, entering the game results for the week and following the prompts. Nominations must be made by no later than 11:59pm AEST on the Tuesday following each round. Votes must be submitted in accordance with the promotion requirements and via the program website on a weekly basis during the Promotional Period, however, please note that voting is only open between Monday, 16th May 2011 and Tuesday, 23rd August 2011.
6. Votes can only be submitted by the Eligible Club’s Team Nominator. Once an Eligible Club’s team has submitted their votes for any particular round, votes cannot be changed and no further votes can be submitted.
7. In the case that a team from an Eligible Club has a bye for any particular round, no votes can be submitted for that team in that round.
8. The individual player in each State/Territory group (NSW/ACT, SA/NT, VIC, TAS, WA and QLD) across all registered Eligible Clubs who receives the highest number of votes during the Promotional Period will receive a trip for two (2) adults to Canberra, valued at up to $2,535. The prize includes up to three (3) nights twin share accommodation at a three (3) star accommodation venue, attendance at a formal dinner presentation with an opportunity to meet Glenn Archer, an ‘Army Challenge’ medal valued at up to $250, an Army branded Sherrin football, a ‘Army Challenge’ branded football jumper and a training session on a series of obstacle courses (i.e. the Over Water Obstacle Course, the Wets Simulation Obstacle Course and the High Wire Obstacle Course), subject to the availability of each obstacle course. Participation in the obstacle course activities is subject to the winner and his/her companion completing all required medical and health assessments (as determined by the Promoter and activity organisers in their absolute discretion).
9. If the winner is not from the ACT, then the prize also includes return economy airfares for two (2) adults from the winner’s nearest capital city to Canberra and return transfers from airport to accommodation, valued at up to $2,965, depending on the winner’s point of departure. If the winner is from ACT, then the prize does not include airfares and return airport transfers and the airfare/airport transfer components of the prize are not redeemable for cash.
10. The prize must be taken on the dates specified by the Promoter, in its absolute discretion, which will be on a weekend between October 2011 and February 2012. The Promoter will notify the Overall Individual (Player) Prize winners of the exact dates the prize must be taken, as soon as practicable after winner determination.
11. If the NSW/ACT group winner is from the ACT, then the prize does not include airfares or airport transfers and the airfare and airport transfer components of the prize are not redeemable for cash. All expenses beyond those stated in these Conditions of Entry, including but not limited to meals, insurance, transport to and from departure point, additional transfers, items of a personal nature, in-room charges, spending money and all other ancillary costs, will be the responsibility of the winner and his/her companion.
12. In the event that multiple individual players in any State/Territory group are tied at exactly the same highest number of votes at the end of the Promotional Period, the Promoter will conduct a random draw between all tied participants at the same time and place as the Weekly Individual Prize draws on Tuesday, 6th September 2011 in order to determine a winner for that State/Territory group.
13. The following conditions apply to the Overall Individual (Player) Prize:
· The winner in each State/Territory group and his/her companion must depart from and return to the same departure point and travel together;
· The itinerary of the winner and his/her companion will be determined by the Promoter in its absolute discretion;
· The winner may be required to present a credit card at time of accommodation check in;
· Frequent flyer points will not form part of the prize; and
· Certain elements of the prize are subject to the standard terms and conditions of individual prize and service providers, such as the airline and accommodation provider.
14. The Overall Individual (Player) Prize provides the winner (and his/her companion) with an opportunity to meet Glenn Archer, and an opportunity to have a photograph taken with Glenn Archer. These elements of the Overall Individual (Player) Prize are not guaranteed and are subject to the goodwill of Glenn Archer on the day. The Promoter accepts no responsibility and will not offer any alternative in the event that these elements of the Overall Individual (Player) Prize cannot be offered for any reason.
15. Total value of all six (6) Overall Individual (Player) Prizes nationally is up to $33,000, depending on each winner’s point of departure (up to $5,500 for each State/Territory group).
Minor Individual (Player) Prizes
16. The top five (5) players (including the winners of the Overall Individual (Player) Prizes) in each State/Territory group (NSW/ACT, SA/NT, VIC, TAS, WA and QLD) with the highest number of votes will also win an ‘Army Challenge Award’ branded jumper valued at $65.
17. In the event that multiple individual players in any State/Territory group are tied at exactly the same highest number of votes at the end of the Promotional Period, the Promoter will conduct a random draw between all tied participants at the same time and place as the Weekly Individual Prize draws on the Tuesday, 6th September 2011 in order to determine a winner in that State/Territory group.
18. Total value of all thirty (30) ‘Army Challenge Award’ branded jumpers nationally is $1,950 (up to $325 for each State/Territory group).
Monthly Club Prizes
19. To submit points for an Eligible Club they support, general members of the public are required to register their details on www.defencejobs.gov.au/armyaward and play the relevant monthly online game as outlined below:
a) Kicking online game (“First Quarter Game”)
The First Quarter Game is available to be played online between Monday, 16th May 2011 and 11.59 AEST at Sunday, 12th June 2011 (“First Quarter Game Promotional Period”).
For every one (1) “metre” that is kicked by a member of the public during the First Quarter Game, the Eligible Club to whom the individual supports will receive one (1) point (e.g. 60 metres = 60 points). Members of the public who do not want to play the game can choose the option submit a “quick kick”. If they chose this option the Eligible Club they have elected to support will be awarded ten (10) points. Each person is allowed one (1) ‘kick’/‘quick kick’ per day.
The Eligible Club with the highest number of points scored in each State/Territory group (NSW/ACT, SA/NT, VIC, TAS, WA and QLD) at the end of the First Quarter Game Promotional Period will win:
· a 2 Hour personalised group training session with an Army Personal Training Instructor valued at $250 and
· a $1,000 voucher redeemable at the Winning Eligible Club’s choice of either Bunnings, Harvey Norman or Rebel Sports.
The personalised training session must be taken by a team comprised of a maximum of 30 players aged 18 years or over only from the Winning Eligible Club. The personalised training session must also be taken between June and August (on a date to be determined by the Promoter, in agreement with the Winning Eligible Club, subject to the availability of the Army) at the Winning Eligible Club’s training ground using the training equipment and facilities of the Winning Eligible Club. The Promoter will notify the Winning Eligible Club of the exact date and Army Personal Training Instructor as soon as practicable, after the Winning Eligible Clubs have been determined.
b) Handballing online game (“Second Quarter Game”)
The Second Quarter Game is available to be played online between Monday, 13th June 2011 and 11.59 AEST at Sunday, 10th July 2011 (“Second Quarter Game Promotional Period”).
In the Second Quarter Game, members of the public are given a specified period of time to handball as many balls as possible through a bulls eye on a moving target. For every ball that passes through the bulls eye, the Eligible Club to whom the individual supports will receive twenty five (25) points. For every ball that hits any of the other two (2) designated target areas surrounding the bulls eye, the Eligible Club to whom the individual supports will receive either ten (10) or five (5) points respectively (depending where the ball hit the designated target area on the moving target). Members of the public who do not want to play the game can choose the option submit a “quick handball”. If they chose this option the Eligible Club they have elected to support will be awarded five (5) points. Each person is allowed to play one (1) game of ‘handball’/‘quick handball’ per day.
The Eligible Club with the highest number of points scored in each State/Territory group (NSW/ACT, SA/NT, VIC, TAS, WA and QLD) at the end of the Second Quarter Game Promotional Period will win a $1,000 voucher redeemable at the Winning Eligible Club’s choice of either Bunnings, Harvey Norman or Rebel Sports.
c) Speckie Marking online game (“Third Quarter Game”)
The Third Quarter Game is available to be played online between Monday, 11th July 2011 and 11.59 AEST at Sunday, 7th August 2011 (“Third Quarter Game Promotional Period”).
In the Third Quarter Game, members of the public are given five (5) kicks in which they have to take a ‘speckie’ mark by ‘hanging’ on the shoulders of the man in front, players of the game will be able to see the distance of the ball to be able to judge their hang time and the longer the hang time, the higher the points that will be awarded to the Eligible Club to whom the individual supports. The points range from zero (0) to two hundred and fifty (250) per ball. Members of the public who do not want to play the game can choose the option to submit a ‘quick mark’. If they chose this option the Eligible Club they have elected to support will be awarded ten (10) points. Each person is allowed to play one game of (1) ‘speckie marking’/‘quick mark’ per day.
The Eligible Club with the highest number of points scored in each State/Territory group (NSW/ACT, SA/NT, VIC, TAS, WA and QLD) at the end of the Third Quarter Game Promotional Period will win a $1,000 voucher redeemable at the Winning Eligible Club’s choice of either Bunnings, Harvey Norman or Rebel Sports.
d) Obstacle Course online game (“Forth Quarter Game”)
The Forth Quarter Game is available to be played online between Monday, 8th August 2011 and 11.59 AEST at Sunday, 4th September 2011 (“Forth Quarter Game Promotional Period”).
In the Fourth Quarter Game, members of the public will need to complete an Army Obstacle Course within the specified period of time provided. In the Obstacle Course, points will subtract in partnership with the time being taken to complete the Army Obstacle Course, so the longer the individual takes to complete the Army Obstacle Course, the lower the number of points will be awarded to their Eligible Club of choice. Points are allocated to the Eligible Club to whom the individual supports depending on the time it takes the individual to complete the Army Obstacle Course with a maximum of four hundred and forty-seven and a half points (447.50) per game to be awarded. If an individual takes longer than three (3) minutes in total to complete the Army Obstacle Course, their nominated Eligible Club will receive zero (0) points. Members of the public who do not want to play the game can choose the option submit a “quick course”. If they chose this option the Eligible Club they have elected to support will be awarded ten (10) points. Each person is allowed to complete one (1) ‘Obstacle Course’/‘quick course’ per day.
The Eligible Club with the highest number of points scored in each State/Territory group (NSW/ACT, SA/NT, VIC, TAS, WA and QLD) at the end of the Forth Quarter Game Promotional Period will win a $1,000 voucher redeemable at the Winning Eligible Club’s choice of either Bunnings, Harvey Norman or Rebel Sports.
20. Individuals can only play each monthly online game once per day.
21. In the event that Eligible Clubs are tied at exactly the same highest number of points at the end of a Quarter Game Promotional Period for any of the monthly online games, the Promoter will send each of the tied Eligible Clubs an email with the following question “Explain how your Club best demonstrates Courage, Initiative and Teamwork?” in which the tied Eligible Clubs must respond to via reply email with an answer to the question. The answer must be submitted in 50 words or less and received by the Promoter via email within 48 hours of receipt by the tied Eligible Clubs in order to determine a winner for that State/Territory group. Each tied entry will then be individually judged based on the creative merit provided to the promotional question and their ability to demonstrate Courage, Initiative and Teamwork in the answer provided. The best valid answer received from the tied Eligible Clubs, as determined by the judges, will win the relevant Monthly Club Prize.
22. Limit of one (1) Monthly Club Prize per Eligible Club.
23. Additional points may be accumulated during the season through other incentives as the Promoter sees fit, as communicated on the promotional website.
24. Any ancillary costs associated with redeeming the Bunnings, Harvey Norman or Rebel Sports vouchers are not included. Any unused balance of a Bunnings, Harvey Norman or Rebel Sports voucher will not be awarded as cash. Redemption of the Bunnings, Harvey Norman or Rebel Sports voucher is subject to any terms and conditions of the issuer including those specified on the Bunnings, Harvey Norman or Rebel Sports vouchers.
25. Total value of all twenty-four (24) Monthly Club Prizes nationally is $25,500 (up to $4,250 in each State/Territory group).
26. For the purposes of this promotion, Eligible Clubs will be allocated to the appropriate State/Territory group based on the information listed on the www.sportingpulse.com website.
Overall Club Prize
27. The Eligible Club with the highest number of points scored from all of the monthly online games in each State/Territory group (NSW/ACT, SA/NT, VIC, TAS, WA and QLD) at the end of the Promotional Period will win $4,000 to spend on something which will benefit the club, subject to the written approval of the Promoter.
28. In the event that Eligible Clubs are tied at exactly the same highest number of points at the end of the Promotional Period in one or more of the participating State/Territory groups (NSW/ACT, SA/NT, VIC, TAS, WA and QLD), the Promoter will conduct a random draw between all tied participants at Message Media, Level 22, 385 Bourke Street, Melbourne VIC 3000 on Tuesday, 6th September 2011 at 2pm AEST in order to determine the winner for that State/Territory group.
29. The Winning Eligible Clubs must submit a proposal to the Promoter by 5.00pm AEST on Friday, 23rd September 2011 outlining how they wish to spend the $4,000. If the Promoter approves the proposal, the Winning Eligible Club will then have two (2) weeks to provide the Promoter with an invoice from the company who is supplying the benefitting product and/or service to the Winning Eligible Club for payment. The $4,000 can only be spent with one (1) supplier. In the event that: (a) the Promoter does not approve the proposal; (b) if the Winning Eligible Club does not submit a proposal to the Promoter by the specified date; or (c) the Winning Eligible Club does not provide a suitable invoice in the required two (2) weeks from the date of proposal approval, the Winning Eligible Club will receive a $4,000 voucher of the club’s choice of either Bunnings, Harvey Norman or Rebel Sports.
30. Total value of all six (6) Overall Club Prizes nationally is $24,000 (up to $4,000 in each State/Territory group).
Weekly Individual Prizes
31. All individuals who validly participate in the monthly online games as per clause (18) above, will be entered into a weekly draw. Entries for each weekly draw close at 11.59pm AEST on each Sunday of the Promotional Period. Entries in each weekly draw will NOT be entered into any subsequent weekly draws. The first five (5) valid entries drawn in each weekly draw will win an Army branded Sherrin Football valued at $99.95. There are sixteen (16) weekly draws in total.
32. Weekly draws will be held every Tuesday, following the closing date for the relevant weekly draw between 24th May 2011 and 6th September 2011 (inclusive). All weekly draws will take place at 2pm AEST at Message Media, Level 22, 385 Bourke Street, Melbourne VIC 3000 throughout the Promotional Period.
33. If the same weekly winner is drawn twice during the Promotional Period the Promoter has the right to redraw for a different winner (except in the case of a South Australian draw winner). No person entering the promotion (excluding South Australian residents) can win two (2) weekly prizes.
34. Total value of all eighty (80) Weekly Individual Prizes nationally is $7,996.
Total Prize Pool
35. Total maximum prize pool in each State/Territory group (excluding ACT) of the Overall Individual (Player) Prize, the Minor Individual (Player) Prize, the Monthly Club Prizes, the Overall Club Prize and the Weekly Individual Prizes is up to $22,071.
36. The total maximum prize pool in the ACT of the Overall Individual (Player) Prize, the Minor Individual (Player) Prize, the Monthly Club Prizes, the Overall Club Prize and the Weekly Individual Prizes is up to $19,106.
37. Absolute total maximum prize pool for the entire promotion is up to $92,446.
38. The Promoter, in its absolute discretion, reserves the right, at any time, to verify the Eligible Club’s voting process and/or a players (including a player’s identity, age, Eligible Club and place of residence) and to disqualify any Eligible Club or individual that abuses or tampers with the entry process or who submits a vote or acts otherwise than in accordance with these Conditions of Entry. Incomplete, indecipherable or ineligible votes, registrations or entries, entries containing incorrect contact details, entries containing material which the Promoter considers inappropriate for any reason and entries submitted through illicit means will be deemed invalid. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights, at any stage, does not constitute a waiver of those rights.
39. The Promoter reserves the right, at any time, to invalidate any votes which it reasonably suspects have been submitted using false, incorrect, fraudulent or misleading information, including but not limited to personal details and contact information and/or votes that have been submitted through the use of multiple identities.
40. The Promoter’s decision (including in relation to invalid entries and the awarding of prizes) is final, and no correspondence will be entered into.
41. If there is a dispute as to the identity of an Eligible Club or player, the Promoter reserves the right, in its sole discretion, to determine the means it uses to verify the identity of the Eligible Club or player.
42. No responsibility accepted for late, lost or misdirected votes or registrations.
43. All winners will be notified by telephone and in writing and details will be published on www.defencejobs.gov.au/armyaward on Friday, 24th June 2011 (for winning Eligible Clubs in Quarter 1), Friday, 22nd July 2011 (for winning Eligible Clubs in Quarter 2), Friday, 19th August 2011 (for winning Eligible Clubs in Quarter 3) and Friday, 16th September 2011 (for winning Eligible Clubs in Quarter 4 and all other winning individuals). The names of any winning individuals and any winning Eligible Clubs (for prizes valued at over $250) determined via a random draw will be published in The Australian on Friday, 16th September 2011.
44. Prizes are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
45. If for any reason a winning Eligible Club or winning individual does not take a prize at the time stipulated by the Promoter, then the person/Eligible Club with the second highest number of votes/points will be offered the prize.
46. Where a prize (or part of a prize) is unavailable for any reason the Promoter reserves the right to substitute the prize (or part of a prize) for a prize of equal or greater value and/or specification, subject to any written directions from a regulatory authority.
47.The Promoter may conduct further unclaimed prize draws as are necessary on Monday, 12th December 2011 at the same time and place as the original weekly draws, subject to any directions from a regulatory authority, in order to distribute any prizes unclaimed by that date. In the event of a winning Eligible Club or winning individual of a prize valued at over $250, their name(s) will be published in The Australian on Wednesday, 21st December 2011.
48. The Promoter is not responsible for any incorrect or inaccurate information caused by a website user or any of the equipment or programming associated with or utilised in this promotion, or for any difficulties caused by technical errors or malfunctions, or any combination thereof that may occur in the course of the administration of this promotion, including technical errors or malfunctions of any telephone network or lines, computer on-line systems, servers or computer equipment, any omission, interruption, deletion, defect, delay in operation or transmission, communications line, mobile or satellite network failure, technical problems or traffic congestion on the Internet or website, software failure, theft or destruction or unauthorised access to or alteration of entries. The Promoter accepts no liability for any injury or damage to participants or any other person’s computer related to or resulting from participation in, down-loading or transmitting any materials in this promotion (except for any liability that cannot be excluded by law).
49. Entrants (or their guardian) consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
50. If for any reason this promotion is not capable of running as planned including but not limited to as a result of infection by computer virus, bugs, tampering, technical failures, unauthorised intervention, fraud or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to the fullest extent permitted by law to disqualify any individual or to cancel, terminate, modify or suspend the promotion, as appropriate, subject to any written directions from a regulatory authority.
51. Any cost associated with accessing the promotional website is the Eligible Club’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an Eligible Club to automatically enter repeatedly is prohibited and will render all entries submitted by that Eligible Club invalid.
52. Nothing in these Conditions of Entry limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
53. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize values to that stated in these Conditions of Entry; (e) if the appearance of Glenn Archer is cancelled for any reason beyond the reasonable control of the Promoter; (f) if an obstacle course is unavailable for any reason beyond the reasonable control of the Promoter; (g) if the group training session is postponed/cancelled for any reason beyond the reasonable control of the Promoter; (h) any tax liability incurred by a winning Eligible Club or individual; or (i) the acceptance of or participation in a prize.
54. As a condition of accepting a prize, the winner Eligible Club’s president, individuals of a winning Eligible Club partaking in a personalised group training session prize and the winning individual of the Overall Individual (Player) Prize (and his/her companion) may be required to sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
55. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Eligible Club. Entrants should direct any request to access, update or correct information to the Promoter. All entries will be the property of the Promoter.
56. The Promoter reserves the right to request winners to provide proof of age, identity and residency at the nominated prize delivery address. Identification considered suitable for verification is at the discretion of the Promoter.
57. The Promoter is Manpower Services (Australia) Pty Ltd on behalf of the Commonwealth of Australia (acting through the Department of Defence) of 201 Sussex St, Sydney NSW 2000 ABN 15 071 884 994. References in these Conditions of Entry to the Promoter are references to each of Manpower Services (Australia) Pty Ltd and the Commonwealth of Australia.
